Asbestos victims group claims victory

AVSGF successfully argued that the Government did not adequately carry out the required review of the impact of including mesothelioma victims within the reforms in the Legal Aid, Sentencing and Punishment of Offenders (LASPO) Act 212 (LASPO).
Some facts about mesothelioma and the Diffuse Mesothelioma Payment Scheme
Mesothelioma is caused by exposure to asbestos and is the largest group of occupational cancers. The dormant period is between 20 and 50 years, and the life expectancy of sufferers following diagnosis is usually between 10 months to two years, which means compensation claims need to be processed as quickly as possible, in order to facilitate the sufferer’s wellbeing.
The length of the dormant period means that workers who contract the disease are not often aware that they are a sufferer until they begin to experience the first warning signs. When diagnosis is made, they are often not able to claim from their original employers or insurance companies, either because the companies have since been dissolved, or because insurance details are not available.
The Mesothelioma Act 2014 also set up the Diffuse Mesothelioma Payment Scheme and is funded by the insurance industry.
