Public Law / Rights

Public law concerns the relationship between individuals and the government and oversees the way that public bodies carry out their functions. It is a complex field of rules and principles that exist to ensure that decisions are made fairly and legally.

Most decisions can be challenged through an administrative appeals procedure and in other cases the remedy may need to be a judicial review in the High Court. We represent clients bringing and defending claims for all or part of a case.

Our areas of expertise include the following:

Education
We have considerable experience of advising schools, parents and students on all matters of education law, including school exclusions, admission arrangements, appeals, discrimination claims, special educational needs, Ofsted investigations, Standards and Testing Agency decisions, university appeals including fitness to practice/study complaints to the Office of the Independent Adjudicator.

Disability and equality
We have a sound understanding of the provisions of the Equality Act 2010 as they apply to schools, public bodies and other types of service providers. We can act in county court cases and in tribunal claims as well as in judicial review proceedings.

Health and social care (children and adults)
We understand the duties owed to disabled children, adults and their families, the resettlement of care leavers and young offenders, and all other aspects of health and social care decision making by local authorities, NHS trusts, CAMHS and clinical commissioning groups.

Inquests and coronial law
The death of an individual may cause a Coroner to open an Inquest to establish the circumstances surrounding the death including how, when and why the death occurred. We are experienced in advising and representing bereaved families and interested parties in the Coroner’s Court.

Planning and environment
Our expertise extends to handling a range of disputes including appeals and judicial review of development and regeneration decisions made by the local authority or government, compulsory purchase orders, town and village green applications and heritage and conservation disputes, including demolition consents and tree preservation orders.
